Building a Legacy:
Innovative and Effective Case Resolution
At the Commission Level

The Occupational Safety and Health Review Commission held a public meeting on Thursday, August 30, 2012 as part of its efforts to enhance efficiency and effectiveness in case resolution at the Commission level. In addition to soliciting public input, the meeting featured a panel of distinguished experts in occupational safety and health and administrative law, including Administrative Conference of the United States Chairman Paul Verkuil, Professor Mark Rothstein, and former Commissioner Gary Visscher.

Items on the agenda included: 1) developing an alternative dispute resolution program at the Commission level, 2) e-filing, 3) advisory guidelines for directing cases for review, 4) a "kick-out" guideline for vacating directions for review for cases that remain at the Review Commission for an extended period of time, 5) resolving tie votes at the Commission, 6) the use of summary affirmances of ALJ decisions, 7) narrowing issues in briefing notices, and 8) the use of remands.
