ALJ Decision and Order in Skyline Restoration, Inc., OSHRC Docket No. 19-1736, Directed for Review.
On April 10, 2019, in Brooklyn, New York, an employee of a subcontractor named Jaen Restoration Corp (Jaen) fell to his death from the flat roof of a twelve-story building. The general contractor for the project was the Respondent, Skyline Restoration, Inc. (Skyline). Skyline had subcontracted to Jaen the entire scope of work that was specified in its general contract. That scope of work entailed performing masonry and waterproofing repairs on and around the building’s rooftop water tower. On the day of the fatal fall, the decedent was one of two Jaen employees working on the project. No Skyline employees were present at the time of the fall.
