BY THE COMMISSION:

The Commission has received an apology from Robert Aaron Greenberg, Esquire and the law firm of Tomar, Seliger, Simonoff, Adourian & O'Brien regarding the circumstances surrounding this proceeding and assurances that the parties will use their best efforts in the future to act in conformance with Commission rules and orders.  Because the events involved in this proceeding are old and because the Commission accepts the apology and assurances that it has received, we consider it appropriate to terminate the proceeding on this basis alone.  We make no findings with regard to the matters at issue nor should any inferences be drawn.  The case is hereby CLOSED.
