On August 11, 2016,Respondent notifiedtheSecretarythat heno longerwishedto contest the citationand askedtheSecretaryfor assistance in withdrawing his notice of contest.0F1 <#ftn1> On August 15, 2016, the Secretary filed a Notice of Withdrawal of CitationwithChief Administrative Law Judge Covette Rooney, whoissued an order approving the withdrawal on October 21, 2016. Thejudge’sorder became a final order of the Commission on November 23, 2016. Two months later, onJanuary 27, 2017, the Secretary filed amotion seekingrelieffrom the final orderunder Federal Rule of Civil Procedure 60(b)(1). Fed. R. Civ. Pro. 60(b)(1) (allows for relief fromfinal judgment based upon “mistake, inadvertence, surprise, or excusable neglect”);see also29 C.F.R. § 2200.2(b) (applicability of Federal Rules of Civil Procedure to Commission proceedings).According to the Secretary,he made a“good faith mistake”when he filedaNotice of Withdrawal of Citation instead ofaNotice of Withdrawal of Notice of Contest.
