*DECISION AND ORDER*

This is a proceeding pursuant to section 10(c) of the Occupational
Safety and Health Act of 1970, 29 U.S.C. Sec. 651 et seq.(``the Act'')
to review citations issued by the Secretary of Labor pursuant to section
10(c) of the Act.

Following an inspection of the Respondent's work site, the Secretary of
Labor issued citations and notification of penalties that alleged
serious and other then serious violations of the Act. The case came on
to be heard in New York, N.Y. on February 21, 2002. No jurisdictional
issues are in dispute.

Through diligent efforts of the parties, a settlement was achieved and
was read into the record at the proceeding. The statements of settlement
made at the hearing have been reduced to a written stipulated settlement.

*ORDER*

The terms and conditions of the stipulated settlement, which are
incorporated herein in their entirety, are approved.
