[*2]? – – – In granting Respondent’s motion for summary judgment, the judge concluded that the provisions of 29 C.F.R. ?? 1910.179 were advisory with respect to overhead and gantry cranes constructed before August 31, 1971.? Respondent’s motion for summary judgment also included items 1 and 6 of Citation No. 2 and items 1, 2, and 3 of Citation No. 3.? The parties reached a stipulation of settlement disposing of these items, and the judge affirmed the settlement in his order granting the motion for summary judgment. The provisions of section 1910.179 as to which the judge granted summary judgment in this case are derived from those requirements.
