Brady,\t\t\t\t\t\t\t\t\t\tdated November 25, 1975, is before this Commission for review pursuant to 29 U.S.C. \u00a7 661.\t\t\t\t\t\t\t\t\t\tThat decision is affirmed on the basis of the decisions by a divided Commission in Secretary v.\t\t\t\t\t\t\t\t\t\tSeaboard Coast Line Railroad Co., OSAHRC Docket No. 11904, December 1, 1975, and\t\t\t\t\t\t\t\t\t\tSecretary v. Belt Railway Company of Chicago, 20 OSAHRC 568 (1975). Those decisions are\t\t\t\t\t\t\t\t\t\tdispositive of the instant case.\t\t\t\t\t\t\t\t\t\tRespondent, in its answer to the complaint, admitted the alleged violations and that due\t\t\t\t\t\t\t\t\t\tconsideration was given to the statutory criteria in 29 U.S.C. \u00a7 666(i) in determining the penalty\t\t\t\t\t\t\t\t\t\tproposal. Respondent also stipulated that the exemption question was the only issue in contest.\t\t\t\t\t\t\t\t\t\tAccordingly, the entire citation is affirmed and a penalty of $400.00 is assessed therefor.\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tFOR THE COMMISSION:\t\t\t\t\t\t\t\t\t\tWilliam S. The citations allege that as a\t\t\t\t\t\t\t\t\t\tresult of certain inspections of respondent\u2019s workplaces located at Chicago, Illinois, respondent\t\t\t\t\t\t\t\t\t\tviolated section 5(a) of the Act by failing to comply with 31 Occupational Safety and Health\t\t\t\t\t\t\t\t\t\tstandards promulgated by the Secretary pursuant to section 6 thereof. Notice of proposed\t\t\t\t\t\t\t\t\t\tpenalties were issued with the citations.\t\t\t\t\t\t\t\t\t\tThe parties have stipulated that the matters in issue relate to:\t\t\t\t\t\t\t\t\t\t(a) Whether the citations were issued with reasonable promptness, pursuant to\t\t\t\t\t\t\t\t\t\tsection 9(a) of the Act;\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t(b) Whether the Commission has jurisdiction over the subject matter of the\t\t\t\t\t\t\t\t\t\tproceeding under section 4(b)(1) of the Act; and\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t(c) Whether the standards cited in Items 6 and 18 of the citation in Docket No.\t\t\t\t\t\t\t\t\t\t12215, and Item 8 of the citation in Docket No. 12216, are reasonable.\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tThe Commission has ruled that a delay in issuing a citation as in this case, which is\t\t\t\t\t\t\t\t\t\tattributed to its review by the Secretary\u2019s National Office, constituted an \u2018exceptional\t\t\t\t\t\t\t\t\t\tcircumstance\u2019 which would justify such delay. Secretary v. Louisville and Nashville Railroad\t\t\t\t\t\t\t\t\t\tCompany, Docket No. 5521 (May 1, 1975), \u2014\u2014 OSAHRC \u2014\u2014. Recent decisions of the\t\t\t\t\t\t\t\t\t\tCommission have also held that in the absence of respondent showing prejudice, a delay in the\t\t\t\t\t\t\t\t\t\t\u00a0\t\t\t\t\t\t\t\t\t\t\u00a0\t\t\t\t\t\t\t\t\t\tissuance of a citation will be upheld. Secretary v. Southern Railroad Company, Docket No. 5960\t\t\t\t\t\t\t\t\t\t(October 28, 1975), 20 OSAHRC \u2014\u2014; Secretary v. Coughlan Construction Company, Inc.,\t\t\t\t\t\t\t\t\t\tDocket No. 5303 (October 28, 1975), 20 OSAHRC \u2014\u2014; and Secretary v. Dic-Underhill, A\t\t\t\t\t\t\t\t\t\tJoint Venture, Docket No. 3725 (October 16, 1975), 20 OSAHRC \u2014\u2014.\t\t\t\t\t\t\t\t\t\tIn this proceeding the respondent failed to show that it had been prejudiced by the delay\t\t\t\t\t\t\t\t\t\tin the issuance of the citations and, therefore, it must be held that they were issued in compliance\t\t\t\t\t\t\t\t\t\twith section 9(a) of the Act.\t\t\t\t\t\t\t\t\t\tThe question of jurisdiction as presented in this case has also been resolved by the\t\t\t\t\t\t\t\t\t\tCommission. In Secretary v. Southern Pacific Transportation Company, 13 OSAHRC 258\t\t\t\t\t\t\t\t\t\t(1974), petitions for review docketed, 74\u20133981 and 75\u20131091 (5th Cir.), the Commission ruled\t\t\t\t\t\t\t\t\t\tthat railroads are not entitled to an industry-wide exemption under section 4(b)(1) of the Act, as\t\t\t\t\t\t\t\t\t\tcontended. This ruling was recently upheld and extended in Secretary v. Belt Railway Co. of\t\t\t\t\t\t\t\t\t\tChicago, et. al., Docket No 4616 (October 17, 1975), 20 OSAHRC \u2014. The foregoing decisions\t\t\t\t\t\t\t\t\t\tare binding in this case; and, accordingly, it is held that respondent is subject to the jurisdiction\t\t\t\t\t\t\t\t\t\tof the Commission.\t\t\t\t\t\t\t\t\t\tIn view of the Commission\u2019s jurisdiction, and without any evidence to the contrary, it is\t\t\t\t\t\t\t\t\t\theld that the standards cited are reasonable and have application to the facts in this case.\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tAll other matters pertaining to this proceeding having been stipulated, it is therefore\t\t\t\t\t\t\t\t\t\tORDERED that:\t\t\t\t\t\t\t\t\t\t(1) The citations and notice of proposed penalties are affirmed.\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t(2) The proposed penalty in the amount of $400 is hereby assessed.\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tDated this 25th day of November, 1975.\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tPAUL L.
