O’Keefe, General Electric Company, for the employer Business Representative, Local 506, International Union of Electrical, Radio and Machine Workers, for the employees OPINION: ORDER BY THE COMMISSION: On January 31, 1980, the Commission issued a decision in this case that concluded with the following order: Accordingly, the judge’s decision is reversed and the alleged violation of the Act for failure to comply with the standard at 29 C.F.R. ?? 1910.132(a) is vacated unless, within ten day of the issuance of this decision, the Secretary [the Complainant, Secretary of Labor] requests the opportunity to submit a brief.? Upon receipt of a brief by the Secretary, should he elect to file one, the Commission will determine whether additional briefs are necessary and the parties will be so notified.? The Commission will then reconsider its decision in this case in light of the submissions received. On February 6, 1980, in response to the Commission’s decision and within ten days of the issuance of that decision, the Secretary [*2]? filed a letter with the Commission requesting \”the opportunity to . . . [file a brief] under the Commission’s decision.\” The Commission thereafter issued a briefing notice granting the Secretary’s request.? However, on March 21, 1980, the Secretary filed a second letter with the Commission stating that, \”after reviewing the file and consulting the Area OSHA Offices, the Secretary has decided not to file a brief in the batter.\” Accordingly, for the reasons stated in the Commission’s decision of January 31, 1980, the judge’s decision in this case is reversed, the citation alleging noncompliance with 29 C.F.R. ?? 1910.132(a) is vacated, and the notification of proposed penalty in the amount of $35.00 is vacated.
