This matter is before the Commission on Respondent’s Notice of Contest, dated December 19, 2017, received by the Commission December 21, 2017. On April 4, 2018, the Secretary filed a motion to dismiss Respondent’s Notice of Contest on the grounds it was not filed within the time period prescribed by § 10(a) of the Occupational Safety and Health Act, 29 U.S.C. § 651- 678 (the Act).
