An employee of Respondent Sunbelt Rentals, Inc. (Sunbelt) was injured on December 2, 2019, when he was knocked from a ladder while trying to unjam an overhead garage door at the worksite. The United States Department of Labor, through its Occupational Safety and Health Administration (OSHA), investigated the accident and on January 27, 2020, the Secretary of Labor (Secretary) subsequently issued Sunbelt a three-item citation and notification of penalty under the Occupational Safety and Health Act of 1970 (the “Act”), 29 U.S.C. §§ 651-678, alleging violations of OSHA’s Occupational Safety and Health Standards with proposed penalties totaling $34,698.00.
