This case arises from a fatal drowning that occurred on May 15, 2017 at 333 Franklin Street, Tampa, FL 33602 (Worksite). (Tr. 365-66; Joint Prehearing Statement (Jt. Pre-Hr’g Stmt.); Stipulation of Fact (SF) Nos. 1, 13). The victim, Johnnie Norton, was operating a pressure washer on a dock at the Tampa Convention Center (TCC). Mr. Norton was not wearing a personal flotation device (PFD) when he walked backward off the dock and drowned. (SF 11-12). OSHA opened Inspection No. 1237383 of C&W Facilities Services, Inc. (Respondent or C&W) as a result. (Ex. 1).
