DEFAULT JUDGMENT This matter is before the undersigned on remand from the Occupational Safety and Health Review Commission (Commission). Following a series of events spanning nearly a year, detailed more fully below, the Commission remanded this matter to “provide Respondent with an opportunity to present evidence supporting its claim that it attempted in good faith to participate in the Commission’s proceedings and put forth a meritorious defense” and for the undersigned to determine whether relief is warranted under Federal Rule of Civil Procedure 60(b)(1). Pursuant to the Commission’s directive, a remote hearing was held on February 23, 2022, to provide Respondent the opportunity to present evidence in support of its request for relief.
