The above-captioned case is on remand from the Commission. The Secretary of Labor (Secretary) timely filed a Petition for Discretionary Review (PDR) of the underlying decision (Decision) at issue here. Thereafter, the Commission directed this case for review. On July 28, 2020, the Commission issued its Remand Order (Remand) for further consideration. To recap, this case concerns a claim of alleged discrimination for reporting work-related injuries. It is brought under a new anti-discrimination regulation recently promulgated and published on May 12, 2016, under authority from the Occupational Safety and Health Act of 1970, 29 U.S.C. §§ 651-678 (OSH Act).
