Mid South Waffles, Inc. (MSW) operates a Waffle House restaurant located in Florence, Alabama. After a fire occurred in the restaurant’s kitchen, the Occupational Safety and Health Administration conducted an inspection and issued MSW a six-item, serious citation alleging, as relevant here, a violation of the general duty clause of the Occupational Safety and Health Act, 29 U.S.C. § 654(a)(1), and several violations of the general industry personal protective equipment (PPE) standards.
