On April 17, 2020, Respondent timely filed a Petition for Interlocutory Review, seeking review of Administrative Law Judge Keith E. Bell’s April 10, 2020 Order denying its motion for summary judgment and granting the Secretary’s cross-motion for partial summary judgment. On April 24, 2020, the Secretary timely filed an opposition to the petition. Pursuant to 29 C.F.R. § 2200.73(a), we grant Respondent’s petition and remand the matter to the judge for further proceedings consistent with this order.
