On December 3, 2019, Abrams was engaged in a large waterline installation project near Interstate 35 and Highway 183 in Austin, Texas (Project or Worksite). (Tr. 23, 30-31; Exs. C-4, C 6, p.2). Abrams is a company of about 500 employees that performs highway construction projects. (Tr. 125). Steven Zbranek, vice-president of operations for Abrams, was responsible for all Abrams’ projects. (Tr. 119-20).
